Liens and encumbrances on the title to a property should be evidenced on a title search or commitment. To remove such encumbrances from the title and allow you to possess or sell real estate free from such encumbrances may require filing a lawsuit to “quiet title.” The end result of such a lawsuit is to obtain a judgment from the court that removes the liens and encumbrances, which allows the title company to issue a title commitment or policy without such encumbrances.
